Terms of Request
Park Lane Property Co Pty Ltd (ACN 693 675 786), a licensed property agent of Level 6, 111 Macquarie Street, Hobart TAS 7000 (“Park Lane”, “we”, “us”). By ticking the box and submitting, you confirm you are at least 18 and agree to the following.
1. Your enquiry is your own.
You are contacting us on your own initiative to request a proposal. We did not solicit or approach you to make this enquiry. There is no cost and no obligation. We'll use your details to prepare and discuss a proposal.
2. No agency relationship is created by this form.
Submitting this form does not create any agency appointment, retainer, or obligation for us to act for you. We are only engaged if and when you and we sign a separate written agency agreement. These terms are binding as an acknowledgment, but they are not an agreement for us to act.
3. Existing arrangements.
Your property may be under an agreement with another agent (sale, leasing, or management), possibly with exclusivity, sole-agency, notice or termination terms. It is your responsibility to review and comply with it. We do not advise or encourage you to breach, end, or vary it, and won't advise you on doing so. Under a sole or exclusive agency, appointing another agent during its term may make you liable for commission to more than one agent; please check and get independent legal advice if unsure. We won't enter an agency agreement with you until you've confirmed any previous agreement has ended or you're otherwise free to appoint us.
4. Your information and authority.
Your details are true and correct to the best of your knowledge. You are the registered owner, or otherwise authorised (co-owner with all owners' authority, attorney, executor, trustee, or director) to make this enquiry.
5. Estimates and guidance.
Any price guidance, appraisal, or projection is our opinion, formed on reasonable grounds using the information available at the time. It is not a formal valuation and not a guarantee of any price, rent, or outcome. You shouldn't act in reliance on it without your own enquiries, and to the extent permitted by law we're not liable for loss arising from such reliance.
6. Contacting you about your enquiry.
You consent to us contacting you by phone or email about this enquiry and proposal.
7. Privacy.
We collect this information to prepare and discuss your proposal and to contact you about it. We may disclose it to service providers who help prepare your proposal (e.g. property-data providers such as CoreLogic), and otherwise as required by law. We don’t sell your information. You can access or correct it, or make a privacy complaint, via info@parklaneproperty.co or 1300 755 244. See our Privacy Policy for full details, including any overseas disclosure. We treat your information as confidential.
8. Our materials.
Any proposal, appraisal, or marketing concept we create remains our intellectual property; you may use it to consider your decision. This doesn't affect your ownership of the information you gave us.
9. General.
If any part is unenforceable, the rest continues. Governed by the laws of Tasmania, Australia.
