Privacy Policy

We respect your privacy and handle personal information in accordance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs). This policy explains what we collect, why, who we share it with, and how you can access, correct or complain about how we handle it. We are committed to applying this policy as best practice, whether or not we are currently bound by the Privacy Act in respect of every activity.

2. What personal information we collect

The personal information we collect depends on how you interact with us. It typically includes:

  • Contact details: your name, email address and phone number.
  • Property and intention details: information about the property you are enquiring about (such as its address and features) and your selling, leasing, buying or property-management intentions, plus any other details you choose to give us.
  • Enquiry content: the information you include when you complete our “Request a Proposal” form or otherwise contact us.
  • Consent and submission records: when you submit a form, we record the date and time, your IP address, and the version of the terms you agreed to, so we have a record of your request and consent.
  • Website information: see section 11.

We collect this information directly from you. Where relevant to providing our services, we may also obtain property information from third-party data providers (see section 6) and from publicly available sources such as land titles and planning records. We do not ask for sensitive information through our website forms and ask that you do not send it to us unless we specifically request it.

3. How we collect it

We collect personal information when you complete a form on our website; email, call, message or meet with us; engage us to provide sales, leasing or property management services; or otherwise deal with us in connection with a property. If you provide us with information about another person (for example a co-owner or occupant), please ensure you are authorised to do so and that they are aware of this policy.

4. Why we collect and use it (purposes)

We collect, hold and use personal information to:

  • prepare, discuss and provide a property proposal;
  • respond to your enquiry and communicate with you about it;
  • provide our agency services: sales, leasing and property management;
  • arrange related services where you ask us to (for example marketing, photography, conveyancing or legal services);
  • keep records, including records of consents and the requests we receive;
  • manage our relationship with you, and run, improve and secure our business; and
  • meet our legal, regulatory and professional obligations.

When you submit the “Request a Proposal” form, your consent is to us contacting you about your enquiry. It does not sign you up to any marketing list (see section 8).

5. If you don’t provide the information

You don’t have to give us your personal information, and you can deal with us anonymously or by pseudonym where it is lawful and practicable. However, if you don’t provide the details we ask for, we may not be able to prepare a proposal, respond to your enquiry, or provide our services to you.

6. Who we disclose it to

We disclose personal information only as needed to provide our services and run our business. We may disclose it to:

  • Property-data providers: for example CoreLogic / RP Data, used to obtain property and market information;
  • IT, hosting and customer-management providers: including our website host (Cloudflare) and the providers who store and process information on our behalf;
  • Other service providers we engage on a matter: such as marketing, photography, conveyancing, legal and settlement service providers, where relevant to your instructions;
  • Other parties to a transaction and their representatives, where reasonably necessary to progress a sale, lease or management matter;
  • Professional advisers (such as our lawyers, accountants and insurers); and
  • Government, courts, regulators or other parties where we are required or authorised by law to do so.

We require our service providers to handle personal information consistently with the APPs and only for the purposes we engage them for. We do not sell your personal information.

7. Overseas disclosure

Some of our service providers (for example IT, hosting and customer-management providers) may store or process personal information on servers located outside Australia, including in the United States and other locations where our providers operate. Our website is served via Cloudflare’s global content-delivery network. Where overseas disclosure occurs, we take reasonable steps to ensure those recipients handle your information in a manner consistent with the APPs.

8. Direct marketing

Submitting the “Request a Proposal” form does not opt you into marketing. We use the details you give us to respond to and act on your enquiry. If, separately, you ask to receive updates or we are otherwise permitted to send you marketing about our property services, any marketing messages will be sent consistently with the Spam Act 2003 (Cth) and the Privacy Act, identify us as the sender, and include a simple way to opt out. You can opt out of marketing at any time by using the unsubscribe option in a message or by emailing info@parklaneproperty.co. We do not use or disclose personal information for marketing by other organisations without your consent.

9. Data quality, security and retention

We take reasonable steps to keep personal information accurate, up to date and complete, and to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, encryption of information in transit, the use of reputable hosting and customer-management providers, and confidentiality obligations on our staff. No system is completely secure, and we cannot guarantee absolute security of information transmitted to us.

We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law, including record-keeping obligations that apply to licensed property agents in Tasmania. As a general rule we retain records for seven (7) years, unless a longer period is required. When we no longer need it, we take reasonable steps to destroy or de-identify it.

10. Access and correction

You can ask us for access to the personal information we hold about you, and to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact our Privacy Officer (section 1). We will respond within a reasonable time, and aim to do so within 30 days. We may need to verify your identity first. In limited circumstances we may decline access or correction as permitted by the Privacy Act, in which case we will explain why and how you can respond.

11. Cookies and website analytics

Other than what is necessary to operate and secure the website and to process your form submission, we do not use cookies or third-party analytics on this site.

12. Complaints

If you have a concern about how we have handled your personal information, please contact our Privacy Officer (section 1). We will acknowledge your complaint and aim to respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC):

13. Changes to this policy

We may update this policy from time to time. The current version will always be available at parklaneproperty.co/privacy, and the effective date shows when it was last updated. Material changes take effect when we publish the updated policy.

This policy is governed by the laws of Tasmania, Australia.
